These Terms of Use ("Terms") govern your access to and use of the Is The Mountain Out? website at isthemountainout.com and the Is The Mountain Out? iOS app (together, the "Service"), provided by Rainier Watch ("we," "us," "our"). By accessing or using the Service you agree to these Terms.
The Service is a community-powered mountain visibility report. We share what people see; we don't guarantee what's actually happening on the mountain. Be kind, don't break things, and have fun watching the mountain.
You must be at least 13 years old to use the Service. If you're using the Service on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.
You can use much of the Service anonymously. If you create an account, you're responsible for keeping your credentials secure and for activity that happens under your account. Let us know promptly at [email protected] if you suspect unauthorized access.
While using the Service, you agree not to:
We may suspend or terminate access for any user who violates these Terms.
You retain ownership of any photos, reports, or other content you submit ("Your Content"). By submitting Your Content, you grant Rainier Watch a worldwide, royalty-free, non-exclusive license to host, display, distribute, and use Your Content for the purpose of operating and promoting the Service (for example, displaying recent reports, sharing community photos, or including them in social posts). You can request removal of any photo you uploaded by emailing [email protected].
You're responsible for Your Content and confirm you have the rights to share it.
Aside from Your Content, the Service and everything in it (including the design, code, copy, logo, and aggregated mountain status data) is owned by Rainier Watch or our licensors and is protected by copyright, trademark, and other laws. Don't copy, modify, or redistribute the Service without our written permission.
The Service is informational only. Mountain visibility reports are crowdsourced and may be incomplete, delayed, or wrong. The Service is not a substitute for professional weather forecasting, avalanche bulletins, route information, or your own judgment. Do not rely on the Service for any decision that affects your safety. Talk to qualified guides, check the National Weather Service, and use your own training and common sense.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, Rainier Watch, our contributors, and our service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service is limited to one hundred U.S. dollars ($100).
You agree to indemnify and hold Rainier Watch harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of Your Content, your violation of these Terms, or your misuse of the Service.
You can stop using the Service at any time. We can suspend or terminate your access at any time, with or without notice, if we reasonably believe you've violated these Terms or to protect the Service.
If you use the iOS app, you also agree to Apple's Licensed Application End User License Agreement ("Apple's EULA"), which applies to the iOS app in addition to these Terms. To the extent of any conflict between these Terms and Apple's EULA on a topic Apple's EULA must govern, Apple's EULA controls for that topic.
Apple is not a party to these Terms. Apple has no responsibility for the iOS app or its content. Apple is not responsible for any claims, losses, liabilities, damages, costs, or expenses related to the iOS app, including product liability claims or claims that the iOS app fails to conform to any legal or regulatory requirement. Any questions, complaints, or claims regarding the iOS app should be directed to us at [email protected], not to Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS app and, upon your acceptance of these Terms, have the right (and will be deemed to have accepted the right) to enforce these Terms against you with respect to the iOS app.
TestFlight beta. While the iOS app is in TestFlight beta, additional Apple TestFlight terms apply. Beta builds may be unstable, may be withdrawn at any time, may contain features that are removed or change before release, and are governed by Apple's beta program rules. Don't rely on beta builds for anything safety- or time-critical, and don't share screenshots of unreleased features publicly without our written permission.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in King County, Washington.
We may update these Terms from time to time. If we make material changes, we'll update the effective date at the top and (where appropriate) notify you via the Service or by email. Continued use of the Service after changes constitutes acceptance.
